OVERVIEW

This website and online store are operated by Jofe Babe Digital Book Store. Throughout these Terms, “we,” “us,” and “our” refer to Jofe Babe Digital Book Store.

These Terms of Service govern your access to and use of our website, online store, content, features, products, and services. By visiting our store, creating an account, placing an order, or using our services, you agree to these Terms of Service and our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree with these Terms, please do not use our website or services.

  1. CUSTOMER ELIGIBILITY

You must be at least the age of legal majority in your state or country to place an order. Our books and products may be created for children, but purchases must be completed and supervised by an adult.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

  1. STORE USE

You may use our store only for lawful personal or household shopping purposes. You may not use our website, products, files, images, or services for fraudulent, abusive, illegal, or unauthorized purposes.

You may not attempt to interfere with the security, operation, checkout, payment processing, customer accounts, or functionality of the store.

  1. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, colors, dimensions, materials, formats, prices, and images accurately. Colors and appearance may vary slightly depending on your screen, device, print provider, materials, or production process.

Please review the product description, size information, format, quantity, shipping address, and other order details before completing checkout.

We may update, correct, limit, discontinue, or remove products and product information when reasonably necessary.

  1. MADE-TO-ORDER PRODUCTS

Our coil-bound printed books and print-on-demand apparel are made specifically for each customer after an order is approved.

Production may be completed by third-party fulfillment partners, including Lulu Direct for printed books and Printify or its selected print providers for apparel and future merchandise.

Production time is separate from carrier transit time. Products from different fulfillment partners may arrive in separate packages and on different dates.

  1. PRICES AND PAYMENT

Prices are displayed in United States dollars unless otherwise stated. Applicable taxes, shipping fees, and other charges are displayed during checkout before payment is submitted.

By providing payment information, you represent that you are authorized to use the selected payment method. You authorize Shopify Payments and applicable payment processors to charge the total displayed at checkout.

We may correct an obvious pricing or listing error. If an error affects a completed order, we will contact you before proceeding whenever reasonably possible.

  1. ORDER ACCEPTANCE

Submitting an order does not guarantee acceptance. We may cancel or decline an order because of suspected fraud, payment failure, incorrect product or pricing information, production limitations, shipping restrictions, or other reasonable operational concerns.

If we cancel a paid order before production, the applicable amount will be returned to the original payment method.

  1. ORDER CANCELLATIONS

Cancellation requests must be submitted within one hour of purchase. A cancellation is not guaranteed because made-to-order production may begin quickly.

Once an order has entered production, it generally cannot be changed or canceled. Please email JofeBabeMedia@gmail.com immediately and include your order number when requesting a cancellation.

  1. SHIPPING AND DELIVERY

Production times and delivery estimates are estimates, not guaranteed delivery dates. Carrier delays, weather, holidays, customs processing, incorrect addresses, and other circumstances outside our control may affect delivery.

Customers are responsible for providing a complete and accurate delivery address. Address changes are not guaranteed after production or shipment begins.

  1. RETURNS, REFUNDS, AND REPLACEMENTS

Because physical products are made to order, we do not accept returns or exchanges for choosing the wrong size, color, product, or format, or for a change of mind, except where required by law.

If an item arrives damaged, defective, misprinted, or different from the item ordered, contact us within 30 days of delivery. Include your order number, a description of the problem, and clear photographs of the item and packaging when applicable.

Approved claims may qualify for a replacement or refund under our Return & Refund Policy:

Do not mail a product to any address without receiving return authorization and instructions from us.

  1. DIGITAL CONTENT

When digital products are offered through Jofe Babe, they are licensed for the purchaser’s personal, noncommercial use only unless the product listing expressly provides different rights.

Digital files may not be copied for resale, redistributed, uploaded to file-sharing services, republished, or presented as another person’s work.

Because digital content can be accessed or downloaded immediately, digital purchases are generally final once access or delivery has occurred, except where the file is defective, inaccessible due to our error, or a refund is required by law.

  1. INTELLECTUAL PROPERTY

All original books, illustrations, characters, logos, graphics, text, downloadable files, product designs, photographs, and website content owned by Jofe Babe Digital Book Store or Jofe Babe Media are protected by applicable intellectual-property laws.

Purchasing a product does not transfer copyright, trademark, reproduction, resale, distribution, or commercial-use rights to the customer.

You may not reproduce, modify, sell, distribute, publish, or commercially exploit our protected content without prior written permission.

  1. CUSTOMER REVIEWS AND SUBMISSIONS

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is truthful, lawful, and does not violate another person’s rights.

You grant us a non-exclusive right to display and use voluntarily submitted reviews or feedback in connection with operating and promoting the store. We may remove content that is unlawful, abusive, misleading, or inappropriate.

  1. THIRD-PARTY SERVICES AND LINKS

Our store may use or link to third-party services, including Shopify, payment processors, Lulu Direct, Printify, shipping carriers, social-media platforms, and other service providers.

Third-party services may have their own terms and privacy practices. We are not responsible for third-party websites or services that we do not own or control, except to the extent required by law.

Shopify and other service providers may process information as necessary to operate checkout, payments, fraud prevention, fulfillment, shipping, analytics, and customer support.

  1. PROHIBITED ACTIVITIES

You may not:

  • Use the store for unlawful or fraudulent activity.

  • Submit false payment, identity, billing, or delivery information.

  • Attempt to gain unauthorized access to customer, store, or administrative systems.

  • Upload viruses, malicious code, or harmful material.

  • Scrape, harvest, or misuse customer or store data.

  • Infringe copyrights, trademarks, privacy rights, or other legal rights.

  • Resell, redistribute, or commercially exploit protected digital content without authorization.

  • Interfere with checkout, payment processing, fulfillment, or store security.

We may suspend access, cancel affected orders, or take appropriate action when these restrictions are violated.

  1. DISCLAIMER OF WARRANTIES

We make reasonable efforts to operate the store accurately and securely. However, to the fullest extent permitted by law, the website and services are provided on an “as available” basis.

We do not guarantee uninterrupted access, error-free operation, or that every product will always remain available. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Jofe Babe Digital Book Store will not be liable for indirect, incidental, special, or consequential losses arising from use of the website, delays outside our reasonable control, or misuse of products or content.

Nothing in these Terms limits liability that cannot legally be limited or excludes rights provided by applicable consumer-protection law.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the website, infringement of another person’s rights, or material violation of these Terms.

  1. SEVERABILITY

If any part of these Terms is found unenforceable, that portion will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

  1. WAIVER

Our failure to enforce a provision immediately does not waive our right to enforce it later.

  1. TERMINATION

We may restrict or terminate access to the store when reasonably necessary because of fraud, abuse, unlawful conduct, security concerns, or a material violation of these Terms.

Obligations concerning payment, intellectual property, prohibited use, liability, and other provisions intended to survive will remain effective after termination.

These Terms are governed by the applicable laws of the State of Georgia and the United States, without limiting any mandatory consumer rights available under the laws of the customer’s jurisdiction.

We may update these Terms to reflect changes in our products, services, business practices, technology, or legal obligations.

The revised Terms will be posted on the store with an updated effective date. Continued use of the store after an update constitutes acceptance to the extent permitted by law.

  1. ENTIRE AGREEMENT

These Terms, together with the policies referenced above and the information presented during checkout, form the agreement governing your use of this store and your purchases.
